1. User Terms of Use
Article 1 — Purpose
Vivid Update Co., Ltd. (hereinafter "the Company") provides the use of Cafe Filament (hereinafter "the Facility") and its ancillary services (hereinafter collectively "the Service") based on these User Terms of Use (hereinafter "these Terms"). Users shall use the Service in compliance with all rules and regulations established by the Company.
Article 2 — Rules
The Company may establish and amend these Terms and related regulations at any time, with such changes applying to all Users. By using the Service, Users are deemed to have agreed to these Terms and any amendments. The Company will notify Users of new or amended regulations via the website or other appropriate methods.
Article 3 — Users
A "User" refers to an individual or corporation that has completed the registration procedure. The Company may establish multiple types of user qualifications and change their content and conditions at any time.
Article 4-1 — User Eligibility
Those wishing to use the Service shall complete the registration procedure. Fees paid at the time of use are non-refundable. Persons affiliated with organized crime groups or antisocial forces are not eligible to use the Service.
Article 4-2 — Registration Procedure
Upon completing registration, a membership card (digital or physical) will be issued. Please present it upon request. Identity verification documents (driver's license, passport, health insurance card, etc.) may be required at registration.
Article 5 — User Rights and Obligations
Users may use the Service in accordance with these Terms. The Company does not grant Users any ownership, lease, or other rights to the Service or its property. Users must fulfill their payment obligations and other duties under these Terms.
Article 6 — Membership Card and Status
Users may not transfer or lend their membership card or user status to third parties. If a third party uses the Service with a User's card for any reason, all resulting liability including payment rests with that User. User status is non-transferable upon death.
Article 7 — Usage Fees
The Company may determine and change the amount, payment method, and payment date of usage fees. Fees are calculated as specified by the Company and cannot be offset against the Company's obligations to the User. If payment is not made by the due date, the Company may take collection action and suspend or expel the User.
Article 8 — Suspension of User Status
The Company may suspend a User's status indefinitely in the following cases:
- Non-payment of fees
- Violation of these Terms or related regulations
- Loss of financial credibility due to bankruptcy proceedings, etc.
- Inability to contact the User for more than 1 month due to unupdated or false registration information
- Causing inconvenience to other Users or the Company
- Criminal conviction or suspicion causing loss of social credibility
- Discovery of affiliation with organized crime or antisocial forces
- Other conduct deemed inappropriate by the Company
Article 9 — Damages
If a User causes damage to other Users, the Company, or Company staff by violating laws or these Terms, the User is obligated to compensate for all such damages immediately.
Article 10 — Service Discontinuation / Changes / Closure Days
The Company may discontinue, change, suspend, or terminate all or part of the Service. Regular holidays may be increased, decreased, or changed. In case of natural disasters or facility renovation, all or part of the Service may be changed for a reasonable period. Users will be notified in advance by appropriate means, except in emergencies.
Article 11 — Fees and Payment Methods
All fees for using the Service shall be paid according to the Company's instructions.
Article 12 — Management of Personal Belongings
Users are solely responsible for managing their belongings within the Facility. The Company bears no liability for theft, loss, or accidents that occur within the Facility.
Article 13 — Notices
Users must register their address and email with the Company and promptly report any changes. The Company bears no liability for any disadvantage caused by a User's failure to update registration information. All notices will be sent to the registered address or email.
2. Facility Rules
Article 1 — Food, Beverages & Smoking
Food and beverages shall in principle be consumed only at your seat. Bringing in items with strong odors or that may disturb other Users is generally prohibited. The entire facility is non-smoking.
Article 2 — Prohibited Activities
Photography inside the Facility is generally prohibited; prior approval is required. Security cameras and microphones are installed for safety purposes. Listing the Facility's address on business cards, websites, or printed materials without prior written approval is generally prohibited. Attire deemed inappropriate for the atmosphere may result in being refused service. Leaving baggage unattended for more than 1 hour may result in it being moved by staff. Solicitation for pyramid schemes, multi-level marketing, or religious activities is strictly prohibited. The Company does not make announcements to call or guide specific customers.
Article 3 — Copying / Printing / Scanning
A multifunction printer is available. Fees are available at the front desk. Usage is at the User's own responsibility. The Company is not liable for any disadvantage caused by downloaded printer drivers or output viewed by third parties. Illegal or improper use will result in suspension or expulsion and legal action.
Article 4 — Lockers
Lockers are available in the Facility. Usage and fees are available at the front desk. Usage is at the User's own responsibility. Illegal or improper use will result in suspension or expulsion and legal action.
Article 5 — Communications
Users may bring their own laptops and tablets. Wireless/wired LAN is available. Usage is entirely at the User's own responsibility, including management of personal data. The Company bears no liability for any unexpected incidents arising from use of the network.
Article 6 — Contact and Administrative Procedures
Event announcements and facility rental notifications will be communicated via LINE, email, or the Cafe Filament website. Important notices may also be sent by post. Users must promptly notify the Company of any changes to their address, phone number, email, or workplace. Various procedures are handled at the Facility.
Article 7 — Emergency Evacuation
In the event of a fire, earthquake, or other emergency, please evacuate the building immediately.
3. Monthly Membership Terms
Article 1 — Purpose
Vivid Update Co., Ltd. provides the Service based on the Monthly Membership Terms. The User Terms of Use also apply to monthly members; in case of conflict, these Monthly Membership Terms take precedence. The Service aims to provide members with access to the café and opportunities for mutual interaction.
Article 2 — Rules
The Company may establish and amend rules at any time; changes apply to all members. By using the Service, members are deemed to have agreed to these Terms. New or amended rules will be posted on the website or notified by appropriate means.
Article 3 — Monthly Members
A "monthly member" refers to an individual who has completed the monthly membership registration procedure. The Company may establish multiple types of monthly membership and change their content and conditions at any time.
Article 4 — Registration
Those wishing to register shall complete the registration procedure and pay the applicable plan fee. Upon completion, a membership card (digital or physical) will be issued. Please carry it at all times and present it upon request; failure to present it will generally prevent use of the Service. Membership fees paid at registration are non-refundable upon cancellation or service termination. Persons affiliated with antisocial forces are not eligible for registration.
Article 5 — Cancellation
Cancellation shall be processed through the Company's designated method, taking effect from the following month. Cancellation by phone or email is generally not accepted. After cancellation, the Facility may still be used on a drop-in basis.
Article 6 — Fees and Payment
Monthly fees are charged by credit card on the 1st of each month. For mid-month registration, a pro-rated amount is charged by credit card on the day of registration. Fees for remaining days after mid-month cancellation are non-refundable. Cancelling on the last day of the month avoids unused days. If payment is not made by the due date, the Company may suspend or expel the member.
Article 7 — Suspension of Membership
If credit card payment fails, the Company may request the member to contact their card company. Repeated payment failures will result in automatic suspension of membership.
Article 8 — Member Rights and Obligations
Members may use the Service in accordance with these Terms. The Company does not grant members ownership or lease rights to the Facility or its property. Members must fulfill their payment obligations. Members acknowledge that third parties designated by the Company may also use the Facility. Members must report any changes to registered information through the designated procedure.
Article 9 — Membership Card and Status
Members may not lend their membership card to third parties. If a third party uses the Facility with a member's card for any reason, all liability rests with that member. The membership card may not be transferred, pledged, or otherwise disposed of. Membership status and associated rights may not be transferred or lent. Membership is automatically terminated upon death.
Article 10 — Suspension of Membership Status
The Company may suspend a member's status at its discretion and without time limit in the following cases:
- Non-payment of fees
- Violation of these Terms or related regulations
- Loss of financial credibility due to bankruptcy proceedings, etc.
- Inability to contact the member for more than 3 months due to unupdated or false registration information
- Causing inconvenience to other members or the Company
- Criminal conviction or suspicion causing loss of social credibility
- Discovery of affiliation with organized crime or antisocial forces
- Other conduct deemed inappropriate by the Company
Article 11 — Expulsion
The Company may expel a member at its discretion in the following cases: damaging the reputation of the Company or Facility; acting against the interests of the Company, Facility, or staff; or meeting any suspension criteria. Upon expulsion, the member immediately loses all rights and benefits.
Article 12 — Damages
If a member causes damage to other members, the Company, or Company staff by violating laws or these Terms, the member is obligated to compensate for all such damages immediately.
Article 13 — Discontinuation / Changes / Closure
The Company may discontinue, change, close, or suspend all or part of the Service at its discretion. In case of natural disasters or facility renovation, all or part may be closed for a reasonable period. Members will be notified in advance except in emergencies.
Article 14 — Management of Personal Belongings
Members are solely responsible for managing their belongings. The Company bears no liability for theft, loss, or accidents within the Facility.
Article 15 — Notices
Members must register their address and email with the Company and promptly report any changes. The Company bears no liability for disadvantage caused by failure to update. All notices will be sent to the registered address, email, or SNS account including LINE.
Article 16 — Check-in and Check-out
Within the hours stipulated by the contracted plan, no basic usage fee is charged at check-out (private rooms and lockers are governed by separate rules). Please present your membership card at both check-in and check-out.
Article 17 — Usage Outside Plan Hours
Use outside contracted plan hours will incur drop-in fees, and the User Terms of Use (not the Monthly Membership Terms) will apply.
Article 18 — Closure and Suspension
The Service may reduce hours or close temporarily for the following reasons:
- Natural disasters, weather emergencies, earthquakes, or other force majeure events
- Facility remodeling, expansion, repairs, maintenance, or inspection
- Significant changes in social conditions
- Exclusive reservation use
- Other circumstances that make it difficult or inappropriate to operate
Advance notice will be given on the premises and website. Monthly fees will generally not be refunded in such cases.
Article 19 — Prohibited Activities
Use of a contracted plan by anyone other than the registered member is prohibited. If such use is confirmed, the membership will be terminated immediately with no refund.
4. Important Notes
- From 6:00–10:00 AM Monday–Sunday, the Facility operates unstaffed with auto-lock (security cameras and auto-lock are in place for your safety).
- The first month's membership fee is automatically pro-rated to the end of the month and charged on the day of registration.
- From the following month, fees are automatically charged on the 1st of each month.
- Cancellation is available at any time via the LINE form. Once cancelled, re-registration is not possible until the monthly fee has been debited (typically the following month or later, depending on the card company). There are no refunds for remaining days in the cancellation month.
- Lockers are available for ¥1,100/month. A separate contract is required.
- During unstaffed morning hours, the first person to arrive is asked to perform the machine open (coffee machine setup). Latte options are not available during unstaffed hours.
- Soft drinks and snacks are rotated periodically. Thank you for your understanding.
- Rental items are not available during unstaffed hours.
- Private room reservations must be made in advance during regular staffed hours.
- Emergency evacuation routes and contact information are posted on the black door next to the private room at the back of the café.
- The student plan is available for junior high school students and above. Elementary school students and below are not eligible.
- Student plan members are required to present their student ID at each visit (except during unstaffed hours).
- Paid services such as printing are not available during unstaffed hours.
- The Company is responsible for equipment damage or malfunction during unstaffed hours unless caused by the customer's intentional act or negligence.
- In the event of an accident (incident, injury, etc.) during unstaffed hours, please contact the police or fire department (ambulance) yourself. By registering, you agree that the Company cannot respond to such incidents.
- Security cameras are checked regularly and irregularly but are not guaranteed to be monitored at all times.
- During exclusive reservation periods, the Facility is unavailable to general members. Exclusive reservation schedules will be announced in advance via LINE. There may be up to 5 exclusive reservation days per month. Changes to operating hours will generally be announced 1 week and 1 day in advance via LINE and the website calendar.
- For urgent contact, please call 080-1079-5471 (Cafe Filament — Enoki). Please note that calls may not always be answered.
5. Disclaimer
Vivid Update Co., Ltd. bears no liability for any of the following damages occurring at Cafe Filament:
- Damages arising from inability to use a reserved private room
- Damages from unauthorized use, property damage, theft, accidents, equipment failure, fire, natural disasters, infectious disease, water leaks, or other incidents on the premises
- All damages including lost business, transportation costs, and personnel costs resulting from inability to use the Facility on a given day or partial-day closure
- Damages caused by a customer to Cafe Filament, other customers, or third parties through use of the Service, or damages from self-inflicted accidents
- Damages related to health issues, injuries, or work-related matters arising from the customer's own circumstances
- All damages resulting from a customer's violation of the Cafe Filament terms and notes
Furthermore, any liability of Cafe Filament to a customer shall be capped at the usage fee paid for the relevant use.
6. Monthly Membership Payment Flow
Joining / Usage
Membership is available at any time. The first month's fee is pro-rated from the day of registration to the end of the month and charged automatically on the day of registration. From the following month, the full monthly fee is charged on the 1st of each month.
Cancellation
Cancellation can be done via the LINE form. Service is available until the end of the cancellation month. Remaining days are not refunded. To avoid unwanted charges, we recommend cancelling before the 1st of the month.
Changes / Re-registration
Once cancelled, re-registration is not possible until the monthly fee has been debited. Depending on the card company, this may take at least approximately 1 month.
